How Middle Berth Works

In Sleeper (SL) and Third AC (3A) coaches, each bay has three berths stacked vertically: lower, middle, and upper. The middle berth folds up against the wall during the day, allowing two passengers to sit comfortably on the lower berth (or three at a stretch).

At night, the middle berth passenger pulls it down to sleep โ€” at which point the lower berth converts back to a flat sleeping berth too.

The 10 PM Rule โ€” Convention, Not Law

Indian Railways has no published gazette notification specifying "middle berth opens at 10 PM." However:

  • The Railway's own FAQ and passenger guidance documents say middle berth passengers should not occupy their berth during daytime (which is generally interpreted as 6 AM to 10 PM).
  • Most TTEs (Ticket Checking Examiners) follow a 10 PM to 6 AM sleeping window and will enforce it if passengers complain.
  • The High Court of India (various benches) has ruled in favour of lower berth passengers' right to the seating area during daytime in multiple cases.

Who Has Priority If There's a Dispute?

In practice, if a middle berth passenger opens their berth during the day and the lower berth passenger complains:

  1. Politely ask first โ€” most disputes resolve without TTE involvement.
  2. If needed, call the TTE โ€” most TTEs will ask the middle berth passenger to fold up until 10 PM.
  3. Indian Railways' official position (per their own publications) supports the lower berth passenger's right to seating during day hours.

Special Cases

  • Senior citizens / differently-abled: If the upper/middle berth is allotted to a senior citizen, the lower berth passenger should voluntarily swap โ€” though this is socially expected, not legally enforceable.
  • Children: No special middle berth exception for children โ€” same timing rules apply.
  • Long-distance overnight trains: The 10 PM rule is most strictly followed. On short 2โ€“3 hour daytime journeys, norms are more relaxed.
